Terms of Service

You must be at least 18 and able to enter a binding contract. If you use the Service for a campaign, office, or organization, you confirm you are authorized to bind it to these Terms.

You are responsible for your account, keeping your password secure, and all activity under it, including actions by team members you invite.

WinFlip helps you plan, draft, review, approve, and schedule communications in your own voice. Features may change over time. We may add, modify, or remove features with reasonable notice where practical.

• Free trials last for the period shown at sign-up. Unless you cancel before the trial ends, your paid plan may begin automatically.
• Paid plans renew automatically each billing period until canceled. You can cancel anytime; cancellation takes effect at the end of the current period.
• Fees are non-refundable except where required by law.
• You are responsible for applicable taxes.

You own the content you upload, create, or connect, including drafts, materials, and messages ("Your Content"). You give us a limited license to host, process, and display Your Content only to provide and improve the Service for you, as described in ourPrivacy Policy.

You confirm you have the rights to the materials you upload or connect, including files imported from Google Drive.

WinFlip uses AI to suggest drafts and ideas. AI output can be inaccurate or incomplete. You are responsible for reviewing, editing, and approving anything before it is published or sent. Nothing is sent without approval from a team member with the right access.

You agree not to use the Service to:

• Break any law, including election, campaign finance, disclosure, and communications laws.
• Publish content that is defamatory, deceptive, or impersonates another person without authorization.
• Send spam or unsolicited messages in violation of applicable rules.
• Harass, threaten, or incite violence against anyone.
• Infringe intellectual property or privacy rights.
• Attempt to hack, overload, reverse engineer, or interfere with the Service.

You are responsible for meeting any legal requirements that apply to your communications, such as "paid for by" disclaimers.

When you connect third-party services (such as Google Drive, Facebook, Instagram, LinkedIn, or Bluesky), your use of them is also subject to their terms. We are not responsible for third-party services, and they may change or stop working with WinFlip at any time.

The Service, including its software, design, and the WinFlip name and logos, belongs to Project Icarus AI, Inc. These Terms do not give you rights to our trademarks or software except to use the Service as allowed here.

You can stop using the Service and delete your account at any time. We may suspend or end access if you violate these Terms or create risk for others. On termination, your right to use the Service ends, and we handle your data as described in our Privacy Policy.

The Service is provided "as is" and "as available." To the fullest extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee any election, fundraising, or audience result.

To the fullest extent allowed by law, WinFlip will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, data, or goodwill. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

You agree to defend and hold harmless WinFlip from claims arising from Your Content, your communications, or your violation of these Terms or the law.

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict of law rules. Disputes will be resolved in the state or federal courts located in Virginia.

We may update these Terms. We will post the new date above and notify you of significant changes. Continued use after changes means you accept them.
